Job Description:

A highly analytical junior to mid-level lawyer, preferably with experience in the defence of liability claims in a reputable law firm, or in a relevant inhouse environment, preferably with a reputable insurer managing liability claims.

Job Responsibilities:

  • Intimating all new claims, potential claims or any notifiable circumstances or incidents relating to alleged/suspected medical malpractice (“claims”) reported by the business’ various facilities, to its medical malpractice insurers in a timely manner
  • Assisting facilities with all aspects of the management of the claims from their commencement until their resolution, including but not limited to drafting correspondence to third parties, drafting submissions in support of appeals of adverse Medical Liability Committee decisions, as well as the provision of the counsel as described above
  • Communicating with facilities to obtain updates on developments in claims, as required and/or as may be requested from time to time by NMC’s medical malpractice insurers
  • Preparing clinical staff for interviews with healthcare regulators during the course of a regulatory investigation of a medical complaint
  • Liaising with NMC’s Corporate Quality Department as may be required from time to time – for instance, to assist with the interpretation of clinical information (as provided by healthcare facilities and/or their clinicians) proposed to be set out in legal correspondence or other legal documents
  • Review and input into medical malpractice litigation and regulatory proceedings as needed
  • Effective management of external counsel to ensure timely delivery of agreed deliverables within agreed budgets, particularly in claims not covered by NMC’s medical malpractice insurance
  • Project manage complex legal matters pertaining to medical malpractice with multiple stakeholders while being cognizant of various interests, including corporate governance requirements
  • Liaising and negotiating with external stakeholders while always ensuring protection of the business’ commercial, legal, and reputational interests
  • Liaising with and responding to queries from other business departments relating to medical malpractice claims
  • Present to the business’ healthcare facilities and clinical staff from time to time on legal aspects relevant to the conduct of medical malpractice claims, including regulatory and court processes, risk management and contracting
  • Maintain current knowledge of UAE laws pertaining to medical malpractice, insurance, and dispute resolution
  • Other related duties as may be required from time to time, such as improving/streamlining medical malpractice work processes and collaborating with the Senior Manager – Medical Malpractice and the wider Legal team to evaluate, devise and apply effective risk management and business protection strategies

Job Requirements:

  • Demonstrable track record working in-house and/or within the liability claims function of an insurer advantageous
  • Recent UAE experience preferred

Qualification & Experience:

  • 3+ years PQE with emphasis on litigation and dispute resolution experience.
  • Qualifying law degree, either common law or civil law jurisdiction (e.g., LLB, JD)
  • Licence to practice law from a regulated jurisdiction (or recently lapsed licence) preferred
